CASR 47 - THE AUSTRALIAN AIRCRAFT REGISTRATION DISASTER OF YEARS 2000 AND 2001On 21st September 2000 CASA sent a misleading letter to all aircraft owners. The letter says"The new Regulation means that if you are not controlling the maintenance of your aircraft, you are required to transfer your certificate of registration to the person who is." That sentence is seriously misleading. If you own an aircraft and pay for its maintenance, HOLD YOUR HORSES. The new regulation is CASR 47. If you feel even the slightest temptation to transfer your CofR to someone else, read CASR 47 and ignore the letter. If you still feel tempted, engage a lawyer. The main way in which it differs from the old registration system is that the aircraft register no longer contains any information about the ownership of aircraft. This is breathtaking arrogance. Australia has an absoluely clear obligation under Article 21 of the Chicago Convention to provide information about the ownership of Australian aircraft to other countries and to ICAO. Australia can no longer fulfill that obligation. It's not as if the Chicago Convention is one of those busy-body treaties which have been so decried by Australia's Government in the year 2000. The Chicago convention is a very practical tool which brings great benefit to Australia every day of the year. As far as aircraft owners are concerned, the fact that there is no longer an official register which records ownership details will be an inconvenience. There is of course no reason why CASA should operate the register because it's not a safety function. An organisation like REVS which runs a vehicle ownership register could run it. AUSTRALIA IS A DEMOCRACY - AND PARLIAMENT OVER-RULED CASAFortunately, The Australian Democrats, the Australian Labor Party and the Independents were listening when the Government was not.
