Results of AIR SAFETY AUSTRALIA's ballot on Aviation Reform

In the period 10th to 23rd September 2001, AIR SAFETY AUSTRALIA conducted a ballot on aviation reform in Australia.

The result was an overwhelming rejection of the present situation, whereby CASA runs the reform process. Only 4 members want that to continue - out of more than 400 who voted. The majority was in favour of the Minister's Office running the Reform Program, with a slightly smaller number wanting the reform program halted, full stop!

Whilst the ballot was under way, the situation changed dramatically -

Firstly, on 11th September the infamous terrorist attacks took place in the USA. These attacks will provide the basis, in years to come, for all kinds of attempts to restrict our Freedom to Fly Responsibly.

Secondly, on 14th September CASA published Notice of Proposed Rule Making (NPRM) about CASR Part 91, a hostile piece of anti-aviation legislation which bears no resemblance to FAR 91.

Thirdly, on 21st September CASA published a separate NPRM, number 0115ss, which if implemented would have the effect of destroying Ultralight Aviation as we presently know it.

Below are set out the exact results, the question asked, and the remarks made by each and every participant.

THE BALLOT QUESTION

AIR SAFETY AUSTRALIA is conducting a ballot to determine the wishes of members on the matter of aviation reform.  After reading the following question, please decide the order in which you prefer them and number the boxes accordingly - 1 for the alternative you like the most and 3 for that which you like the least.

Australia has been engaged in a program of aviation reform for the past five years.  This program has produced some benefits, such as the Private Instrument Rating.  However it has also produced disadvantages.  It has also produced a lot of confusion and uncertainty.  The process may work better if it were conducted by the Minister's office rather than by CASA.

What is the order of your preference (1 for most preferred, 3 for least preferred)

The reform was achieved only after several parties presented CASA and the minister with detailed drafts of all the changes together with?? Etc. They were derived from the US FARs and NZ and bypassed the legal drafting / CASA. It was a shock to CASA that private citizens should initiate and detail changes direct to parliament. "I cannot trust CASA for a number of reasons 3 of which follows :- CASA receives reports of my indebtedness to airservices etc so they tell me and where else I do not know and Ansett loses 1.3m per day.  So much for financial viability. "CASA has proved beyond reasonable doubt that it is incapable of reforming anything, and is simply involved in self-protection and burgeoning bureacracy, for whatever reasons. The industry, and GAin particular, has lost all faith in CASA, and has no respect for CASA whatsoever. In my view the problem stems from the Office of Legal Counsel in CASA, where relatively inexperienced lawyers are attempting to plug leaks and protect theirarses with ill conceived leglslation discguised as "reform". We have the proof of this in the fact that when they "adopt" foreign legislation, certain key words are altered so as to completely distort the legal effect of teh Australian legislationThe reform process has been corrupted and should be stopped pending a Senate Inquiry."

"Remarks: My view is that none of the above responses are likely to produce a solution fair to all parties. I think that a group should be made up of a representative committee which comprises Industry-Private,Commercial and CASA nominated personal all of equal input with a Chairperson with a casting vote. These recommendations should also be supported with sound reasons for change and open to scrutiny. The recommendations then are passed onto the Minister for implementation. The committee should also be made to report actual progress so that their performance can benchmarked and obliged to progress to a finite conclusion in a given practical time frame. The objectives should be to produce a workable and fair document taking into account similar systems which have already proven effective in other countries and to promote a flourishing Australian aviation industry. I hold a FAA endorsement on my licence and have 40 hours flying light aircraft in USA. Thanks for the information and opportunity to express my humble "Weekend Warrior Views"."

"Sensible and practical aviation reform MUST go ahead, but it MUST be controlled and run from the Minister's Office. Minister Anderson has been seriously remiss in his running of this portfolio. CASA bureaucrats have shown themselves to be incapable of proper consultation with the Industry and the propensity to draft useless punitive legislation such as EVU, AOC'sfor the ultralight movement, changes to C of R Registry etc etc ad nauseum, do NOTHING to enhance safety.Australia has more useless legislation than either the USA, UK, Canada or NZ, yet by comparison we have a pathetic safety record. CASA MUST be controlled and do the bidding of our elected representatives."

"Remarks: Good luck! I sat next to a previously 1st Class Ansett passenger , an SA Government "FatCat" on Virgin to Sydney yesterday, and he was so upset! The seats were too close, and this was really below his status! Just like most of our problem, but it is so much a part of their lifestyle they will always fight harder than us to maintain it!…We need to look at the big picture...privatisation of the department is the only long term solution, as it removes the need to daily fight with a self preserving system. We need to encourage them into the belief that they are so good at what they do (they already know that don't they!) that they can make lots of money, and live like kings under a privatised department!....Encourage them into the real world!"
